These Terms of Service govern your access to and use of Sayar software platforms, website, and related services. By accessing or using our services, you agree to be bound by these terms.
1. Acceptance of Terms
By registering for, accessing, or using any Sayar platform or service, you confirm that you have read, understood, and agree to these Terms of Service. If you do not agree, you must not use our services.
2. Description of Services
Sayar provides enterprise software solutions including but not limited to:
- ISP Billing and Management System
- Point of Sale (POS) System
- Property Management System
- Ride-Hailing Platform
- Custom Software Development Services
3. Account Registration
To use our services, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Payment Terms
Subscription fees are billed monthly in advance. Payments are processed via M-PESA or bank transfer. Failure to pay within the due date may result in suspension of services. All fees are non-refundable unless otherwise stated in writing.
5. Acceptable Use
You agree not to use our services to:
- Violate any applicable laws or regulations
- Transmit spam, malware, or harmful content
- Attempt to gain unauthorized access to our systems
- Resell or sublicense our services without written permission
- Interfere with the operation of our platforms
6. Intellectual Property
All Sayar platforms, software, designs, logos, and content are the intellectual property of Sayar. You are granted a limited, non-exclusive, non-transferable license to use our services for your internal business purposes only.
7. Data Ownership
You retain full ownership of all data you input into our platforms. Sayar will not use your business data for any purpose other than providing the services. Upon termination, you may request an export of your data within 30 days.
8. Service Availability
We strive to maintain 99.9% uptime. However, we do not guarantee uninterrupted access and shall not be liable for downtime caused by factors beyond our reasonable control, including internet outages, third-party service failures, or force majeure events.
9. Limitation of Liability
To the maximum extent permitted by law, Sayar shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, even if we have been advised of the possibility of such damages.
10. Termination
Either party may terminate the service agreement with 30 days written notice. Sayar reserves the right to immediately suspend or terminate accounts that violate these terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes shall be resolved through arbitration in Nairobi, Kenya.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes. Continued use of our services after changes constitutes acceptance of the new terms.
